The components of the General Terms and Conditions, hereinafter referred to as the General Terms and Conditions, apply to all orders in the online shop www.parradoxbrand.com of Parradox Mode, hereinafter referred to as Parradox, as the seller and you as the customer, as well as to purchases for which Parradox defines these General Terms and Conditions as applicable. The components of the general terms and conditions of the contractual partner, on the other hand, do not become part of the agreement between the parties when a contract is formed, even if Parradox may not expressly object to their inclusion.
 

Scope
 

The validity of the GTC is obtained when a contract is concluded between the parties. Thus, these apply to all contractually provided deliveries and services of the online shop www.parradoxbrand.com by Parradox Mode and are based exclusively on these General Terms and Conditions and the associated conditions, even if they are not expressly agreed again. By sending your order to Parradox, you confirm that you have read these terms and conditions and expressly agree to them. By acknowledging these terms and conditions, you as a contractual partner agree to their inclusion in the contract to be concluded with Parradox.

2 Conclusion of Contract
 

The purchase contract is concluded when Parradox accepts your order. This will be confirmed to you by e-mail or SMS and is then binding for you. Parradox reserves the right to accept offers from the contractual partner within a period of 2 weeks after receipt. All goods and prices, offers and information in catalogues, the homepage or other platforms and information carriers within the ordering process are subject to change and non-binding.

By ordering the goods, you confirm that you are aware of your order, its content and scope and, as a contractual partner, declare that you want to purchase the goods in full.

 

 

3 Delivery
 

The order is always sent by post as a standard package or by courier services to the address you have chosen. In Switzerland, the delivery time for this is around 2-5 working days. For deliveries abroad, the delivery times of the post office or courier services apply and depend on the location of the recipient. As a buyer, you are responsible for any costs at the border for duties and taxes. You can track your delivery by checking the status at the post office. In the event that an item is exceptionally unavailable or there are delivery problems along the production and/or supply chain, we will of course contact you by email or SMS as soon as possible. Parradox is entitled to deliver the goods specified in the contract within 2 weeks of accepting the order.

Partial deliveries are generally not sent by Parradox. For larger orders, the longer period applies. If the processing of the entire delivery appears to be more efficient with a partial delivery, Parradox reserves the right to undertake this.
Any shipping costs incurred will be borne by Parradox.

 

4 Model deviations / subject matter of the contract
 

Due to the way of production and processing as well as the materials and finishing items used, almost every article is unique. Slight deviations in the designs, colors and structures as well as the labels are therefore possible.

The subject matter of the contract is expressly only the goods you include in your order and only those that we have accepted as an order.

All offers and services as well as articles, designs and product descriptions in the online shop, catalogs and all other information carriers and sales channels are non-binding.
 

5 Prizes
 

All prices listed in the online shop www.parradoxbrand.com are in Swiss francs, including statutory VAT (7.7%) and excluding shipping costs. Before completing the purchase process, the effective shipping costs are displayed in the shopping cart. Parradox has the right to adjust the prices quoted online at any time without prior notice and without further explanation. The time of the order in the online shop applies to the calculation of the prices.

6 Shipping costs
 

From an order value of CHF 100, shipping in Switzerland is free. If the order value is less than CHF 100, a shipping fee of CHF 7 will be charged.

Deliveries abroad are charged with a shipping fee depending on the location of the recipient. The Swiss Post price zones apply

The payment period for an advance payment by bank transfer is usually 10 days. If you do not meet this deadline, Parradox reserves the right to cancel the order, release the goods for sale again and transfer any costs to you.

All card payments are made through Safepay's secure payment server ( www.safepay.com ). Your data will not be stored by Parradox.

5. Payment with voucher

From a purchase value of CHF 100 in one purchase, you can redeem your voucher once. If the resulting purchase value is below the value for free delivery (CHF 100, see delivery), Parradox will charge a shipping fee of CHF 7.

Parradox is entitled to provide partial services if these are conducive to the execution of the contract and reasonable for the contractual partner. As a contractual partner, you are not permitted to assign a claim against Parradox unless Parradox expressly agrees in writing.

8 Foreign currency
 

In order to make orders from abroad possible, we offer different foreign currencies. The current exchange rate at the time of purchase is set by Safepay and shown transparently (Dynamic Currency Conversion).
 

9 Retention of Title
 

The contractual goods remain the property of Parradox until full payment of the invoice amount. In the case of entrepreneurs exercising their commercial or self-employed professional activity, a legal entity under public law or a special fund under public law, we reserve title to the purchased item until all outstanding claims from the business relationship with the customer have been settled. The corresponding security rights are transferable to third parties. You only have the right to offset if your counterclaims have been legally established or are undisputed or recognized by us. In addition, you only have a right of retention if and to the extent that your counterclaim is based on the same contractual relationship. All outstanding claims will become due if you do not meet your payment obligations and are in default in any way.
 

10 Care handling
 

All items come with care instructions. Parradox points out that this should be observed and accepts no liability whatsoever for damage caused by improper handling or incorrect handling of the ordered goods.
 

11 Guarantee / Warranty
 

The warranty period is two years from delivery of the goods, unless a longer warranty period is expressly stated on the delivered goods. You are obliged to examine the goods immediately after receipt for obvious defects and errors as well as for transport damage. Defective goods must be reported to Parradox in writing within 10 days after delivery or after the damage has occurred, in accordance with the obligation to inspect and report, to the above address, otherwise the warranty claim will lapse. Failure to meet this deadline has no effect on the statutory warranty claims. All items come with care instructions. Parradox points out that this should be observed and assumes no liability for damage caused by improper handling or incorrect handling or wear and tear of the goods ordered. In this case, the warranty claim expires. In the event of a complaint, Parradox requires proof of purchase in order to be able to trace the purchase. You send the goods to be complained about with a copy of the purchase receipt to the address given above. If the contractual partner does not have proof of purchase, this has no effect on the statutory warranties. Parradox reserves the right to make individual decisions in the event of a warranty. The statutory warranty provisions apply to defects in the delivered goods.
 

12 Liability

Parradox hereby expressly points out that no liability claims can be asserted for indirect damage or consequential damage by the customer, unless damage is caused by Parradox intentionally or through gross negligence. Damage from accidents and improper handling are subject to personal responsibility. Apart from that, Parradox is liable in accordance with the statutory provisions if the contractual partner asserts claims for damages based on intent or gross negligence - including intent or gross negligence on the part of the representatives or vicarious agents. The above limitations of liability do not apply to damage resulting from injury to life, limb or health.
 

13 Amendment of the GTC
 

Parradox reserves the right to unilaterally amend these General Terms and Conditions at any time without prior notice, particularly in the event of changes to the relevant legal provisions.


14 Governing Law / Jurisdiction
 

In any case, the relationships between you and Parradox are subject to Swiss law in accordance with the provisions of the Swiss Code of Obligations (OR) and the Swiss Civil Code (ZGB). The application of the provisions of the Vienna Sales Convention (“United Nations Convention on Contracts for the International Sale of Goods”) is expressly excluded.

The place of jurisdiction is the legal domicile of Parradox Mode, currently Grindelwald, Bern, unless the place of jurisdiction is based on the Place of Jurisdiction Act.

Any shipping costs that may arise will be borne by Parradox.

In the event of a complaint, Parradox requires proof of purchase in order to be able to trace the purchase. You send the goods to be complained about with a copy of the proof of purchase to the address given above. If the contractual partner does not have a proof of purchase, this has no influence on the guarantees to which he is legally entitled. Parradox reserves the right to make an individual decision in the event of a guarantee. The statutory warranty provisions apply to defects in the delivered goods.
